WiPO deal, big win for India and Global South .

The World Intellectual Property Organization (WIPO) Agreement on Intellectual Property, Genetic Resources and Allied Traditional Knowledge is an important victory for countries in the Global South and India, which is a large biodiversity hotspot with an abundance of traditional knowledge and knowledge.

For centuries, knowledge and knowledge systems that supported the economy, society and culture are now integrated into the global IP system. It is for the first time that the connection between local communities and their GR and ATK has been recognised in the global IP community. India has long achieved this historic achievement as a provider of traditional knowledge and knowledge and a repository of biodiversity.

This agreement will not only protect and protect biodiversity but also increase transparency in the patent system and strengthen innovation. Through this, the IP system can continue to promote innovation while evolving in a more inclusive way by responding to the needs of all countries and their communities.

The deal is a major victory for India and the global south which has long been a proponent of this tool. After two decades of negotiations and with collective support, the agreement has been adopted at a multilateral level with consensus among more than 150 countries.

For most developed countries, which produce IPs and use these resources and knowledge for research and innovation, the agreement paves the way for eliminating conflicting criteria between IP systems and the protection of biodiversity that have existed for decades.

In the agreement to be approved and executed, the mandatory declaration of the origin of the genetic resource for the patent applicant will have mandatory obligations when the claimed discovery is based on genetic resources or related conventional knowledge. This will provide additional protection to the Indian GR and TK, who are now safe in India while being victims of corruption in countries where they are not disclosing responsibility. Therefore, by creating global standards on disclosure of originary responsibilities, this agreement creates an unprecedented framework within the IP system for countries providing genetic resources and related traditional knowledge.

At present, only 35 countries have some or the other announcement responsibility, most of which are not mandatory and do not have proper restrictions or remedies for effective implementation. The agreement will require contracting parties, including developed countries
